Your initial disability claim

While we don’t actually assist with filing the initial claim, we can give you information or tell you what steps you will need to take when filing for your Social Security benefits. There are two options when filing. You can file online, or you can file in person at a local Social Security Administration office with an appointment.

SSI and SSDI process

There are several steps to the Social Security process. Each case differs from the time that you apply to the appeals process and hearing. Knowing that, it is difficult to give a specific timeline on how long your case will take.

Application State

This is the stage when you file for Social Security on your own using the SSA website or in person.

Reconsideration

If you are turned down during your initial request you have 60 days to hire an attorney to file an appeal. At this point we will meet with you to go over all your medical history, diagnoses, medications, etc. We file a reconsideration on your behalf.

Hearing

If you are turned down during the reconsideration process then we will file to request a hearing in front of a judge. We will present all the evidence in your case to the judge at the scheduled hearing. Hearings are either over the phone, video call or in person. Depending on your case we may request that your hearing be in front of a judge although this may take longer than a phone hearing.

Appeals Council

If you are denied by the judge at the hearing stage, we will request your case be reviewed by the Appeals Council. This is the final option that we can assist you with filing for your Social Security Benefits.

Federal Court

If you decide to pursue your claim further you may want to consult with another attorney regarding filing a lawsuit in federal court.
